| Read the article |Accepting the invitation from the School of Law at Beijing Foreign Studies University to participate in the 18th “BFSU – Wanhuida Cup” Intellectual Property Moot Court Competition, the team from Hanoi Law University—comprising students Hoang Truc An, Nguyen Phuc Anh, and Tran Dao Viet Hung, alongside advisors Dr. Pham Minh Huyen (Faculty of Civil Law) and M.A. Vu Thuy Trang (International Cooperation Department)—participated in the competition held on May 23 and 24, 2026, in Beijing, China, and successfully won a First Prize overall as the Runner-up.

The “BFSU – Wanhuida Cup” Intellectual Property Moot Court Competition is the largest professional English-language debate and moot court competition on intellectual property in China, featuring prestigious judges, senior lawyers, and IP experts from both China and abroad. Organized annually since 2007 by the School of Law at Beijing Foreign Studies University—one of China's leading institutions for foreign language training and research—and primarily sponsored by Wanhuida Intellectual Property, a prestigious Chinese law firm, this year's competition attracted 22 teams. This included 4 international teams from Vietnam, Kenya, Hungary, and Peru, alongside 18 teams from universities across China.

The theme of this year's competition focused on a dispute over a request to invalidate a trademark registration certificate registered in China within the context of cross-border business operations, on the grounds of non-use for three consecutive years. The case raised critical issues regarding the identification of the entity using the trademark, the impact of the trademark owner's intent on the use of the trademark, as well as the application of international trademark standards established under the TRIPS Agreement. In particular, the case addressed the scope of application for the concept of “genuine use” under Article 49.2 of the Chinese Trademark Law.
The dispute over trademark use presented many complex and fascinating legal gaps, requiring in-depth knowledge of intellectual property and strong advocacy skills. However, with well-deserved efforts and sharp, logical, and persuasive arguments in both the written submissions and oral rounds, the Hanoi Law University team excellently won an overall First Prize and a series of prestigious accolades at the 18th “BFSU – Wanhuida Cup” Intellectual Property Moot Court Competition.
In the written submission round, the Hanoi Law University team won the "Best Memorial" award for both the Claimant and Respondent sides, ranking 1st and advancing to the top 16 teams for the live oral advocacy rounds.

In the live oral advocacy rounds, the team competed against Beijing Foreign Studies University and Beijing Institute of Technology in the preliminary rounds; East China University of Political Science and Law in the Semifinals; and China University of Political Science and Law in the Final. Ultimately, Hanoi Law University won the First Prize with the title of Runner-up.

Notably, student Nguyen Phuc Anh—from the High-Quality Bachelor of Economic Law program—delivered an impressive performance defending both the Claimant and Respondent sides to win the title of “The Best Oralist” of the competition, as well as “The Outstanding Oralist” in individual matches.

Additionally, after the conclusion of the competition, Beijing Foreign Studies University organized a China-International Youth Legal Forum to discuss topics related to the issues raised in this year's case. Student Tran Dao Viet Hung—from the High-Quality Bachelor of Law program—presented and led discussions on the identifying function of trademarks, drawing significant interest and lively debate from other participants.

Participating and achieving top results in this competition is a vivid demonstration of the effective cooperation between Hanoi Law University and the School of Law at Beijing Foreign Studies University. This relationship has been painstakingly nurtured by the University, extending beyond academic competitions to future faculty and student exchanges, scientific research collaborations, and joint training programs. This serves as an important foundation contributing to raising Hanoi Law University's international standing and opening up numerous developmental opportunities for the university's legal academic community.
The competition provided memorable opportunities for law students to experience and learn from a professional courtroom environment, create beautiful memories of friendship between nations, encourage creativity, and nurture the passion of young people for the law in general and the field of intellectual property in particular.
